Lackawanna County Commissioners Announce Land Development & Construction Fee Waiver Program

The Lackawanna County Commissioners are implementing additional financial incentives to attract companies looking to relocate to or expand in our community through a new program designed to waive or reimburse a substantial portion of County and local municipal fees involved in a development project.

Details of the Lackawanna County “Land Development & Construction Fee Waiver” Program were announced at a news conference this morning (July 9).

“This program along with the SBA Fee Waiver initiative and in conjunction with State credits and tax incentives form a very attractive package that clearly demonstrates that Lackawanna County is open for business,” said Commissioner Jim Wansacz.  “We want businesses to realize that Lackawanna County wants them to be a part of a progressive business culture.”

“This is another great addition to our economic development toolbox.  We are committed to creating family sustaining jobs here and the Land Development and Construction Fee Waiver Program will help because it is making Lackawanna County a better and more cost efficient place to do business,” explained Commissioner Corey D. O’Brien.  “Waiving a portion of or all of the County fees and helping with municipal costs shows our commitment to growing our economy.”

“This program represents our commitment to assisting our business climate to grow and diversify. We want to assist firms in locating to or expanding in Lackawanna County by covering a portion of the various fees that could take away from their development projects,” noted Commissioner Patrick M. O’Malley.

This program is available to companies relocating to or expanding in Lackawanna County.  A business is eligible for this program so long as the company creates at least 10 new full-time jobs onsite within 24 months of the approval of its application.

The County’s Economic Development Department will manage the program and evaluate the applications on a case-by-case basis.  Funding recipients will be chosen based upon the clearly demonstrated compliance with the eligibility requirements and the overall economic impact on the County.  Decisions will be based on the type of company, number of jobs created, wages, physical or geographic location, and capital investment.

The industries targeted for this program include:

  • Advanced Manufacturing
  • Headquarters and Professional Services
  • Health Sciences, Biosciences and Services
  • Information Technology Solutions
  • Logistics and Supply Chain Management

A portion of or all of the following permits and fees may be reimbursed or waived under this initiative:

  • Municipal land development review fees
  • Municipal zoning and UCC permit fees
  • PennDOT Highway Occupancy Permit or Municipal Driveway Permit Fee (whichever is applicable)
  • Municipal variance, Special exception or Conditional use zoning hearing fees (if a hearing is necessary)
  • State environmental protection permit fees
  • Waiver of all County agency fees (Planning Commission, Conservation District and Engineering)

The funding provided through this program will be reimbursable to the applicant upon submission of copies of all municipal and State approvals, permits, and itemized receipts of fees paid, documented and signed by the appropriate municipal or State agency.  This funding is available only to businesses located in or expanding into Lackawanna County.

Interested parties can obtain an application from either the County’s Economic Development or Community Relations Departments or visit the Economic Development Department page on and search in the Regional Planning Commission area.

The application submission requirements involve providing:

  • Two (2) copies of the application packet, containing original signatures
  • The completed and signed three (3)-page application form LC-LDCFW-1
  • A project description
  • A resolution authorizing the applicant to apply for  this program and agreeing to its “Terms & Conditions”

Progress reports, compliance with Federal, State and Local laws, overpayment provisions, and being current on Federal, State, County and Local taxes are other stipulations of the Land Development and Construction Fee Waiver Program.
